The National Commission on Human Rights, having considered :
1) That the human rights situation and conditions in East Timor following the ballot requires a general assessment to ensure that the process to restore social and living conditions in East Timor, in the aftermath of the pervasive dislocations and human sufferings during the popular consultation, would guarantee the protection of human rights of individuals and the general public in that area;
2) That reports of human rights violations during the post-ballot period need to be immediately studied, investigated, and, if preliminary findings indicate that these reports are credible, these cases must be effectively dealt with in accordance with the existing laws, whoever the perpetrators may be;
Hereby announces the establishment of a Fact-Finding Commission for
Post-Ballot Human Rights
Violations in East Timor with the following provisions:
1) The Fact-Finding Commission for Post-Ballot Human Rights Violations in East Timor is an independent organization, to be known as "KPF";
2) The scope of its mandate is as follows :
a) to collect facts, data and all available information and to investigate, analyze and evaluate reports on human rights violations in the post-ballot period,
b) to process the findings on human rights violations so that action can be taken by the proper authorities in accordance with the existing laws;
c) to compile and submit a full report and make recommendations to the Goverrunent of Indonesia based on the findings of the Commission, which will be announced to the general public in due time.
3) The full structure and membership of the Commission will be determined and announced in the nearest future and will comprise of elements from the National Commission on Human Rights, independent figures and experts who shall conduct their work in their personal capacity.
4) The Commission is open to the possible participation
of international bodies.
